Car Accident in Ohio

What is the name of your state? Ohio
I was parking on the street when the other party backed out of the drive way and we collided in the street. No damage to my car, the other party did not want to call the police. They filled a police report 2 days after the accident. They insist I was at fault. What should I do here? I have given the police all my information. They said it was no-fault, but Ohio does not have a no fault law. The other party is calling and gettting agressive saying it was my fault.

My response:

Why aren't you turning this matter over to your insurance company?

Who is at fault? Who pays? That is all I want to know. If I am at fault fine I will report it. IF I am not why give them anotehr reason to raise the rates...

"Who is at fault?"

Nobody here can tell you the answer to that question.

"Who pays?"

Whoever is found at fault.

Look, they are already claiming that you are at fault. The police report is not as important as you might think -- since the police didn't witness the accident occuring, only the aftermath, their report is just an opinion. The police report is not binding on anyone. The way to handle this is 1. stick to your guns, and end up in court telling your side of the story to the judge, or 2. telling your insurance company what happened, and letting them duke it out with the other party.

If you are not found at fault and the other party pays, they shouldn't have any reason to raise your rates.
