Car accident other drive not insured


What is the name of your state? Ohio

I was involved in an accident which totaled my vehicle, both myself and 1 daughter were taken by ambulance to Hospital, 2nd daughter and friend taken by my husband, the other driver no insurance, my medical bills are over 10,000, my insurance company is telling me that balance over the 10,000 will be paid out of a settlement they will offer me. Is this normal. We have not gotten any resolution after almost 4 months.What is the name of your state?

Out of the settlement WHO will offer you? Your own insurance company? From your Uninsured Motorist coverage? If you only have 10k of PIP coverage, then yes this is normal. If you have health insurance, you can use that after the 10K is exhausted, but you will have to reimburse them out of that eventual settlement money.

my insurance company, 10,000 per person for medical, the rest uninsured motorist, I have started making payments on the bills over $10,000, I was questioning why I should since I was not at fault, and did not cause the accident.

It is because you were underinsured. The money has to come from somewhere so it will come from other insurance payments. You could pay it all out of pocket and attempt to sue the at fault party for reimbursement, that would be another option.

what exactly do you pay insurance for!! The lady that hit me doesn't work, on welfare, rents a home, it would be a little hard to get something from nothing.

I expected some kind of comment like yours.

This post is confusing. You'll have to be a little more clear. Please tell me what I've missed below.

This is what I've gleaned.
*You were the driver of a vehicle, involved in an accident, and you were determined by your insurance company to be 100% not at fault. Your vehicle was totalled, and you have collision coverage OR uninsured motorist coverage which provided you with a check, minus your deductible, for the actual cash value of the vehicle.
*Driver: You. You were injured.
Passenger 1 - daughter 1. Was injured.
Passenger 2 - daughter 2. Was injured.
Passenger 3 - friend. Was injured.

You have medical payments coverage of $10,000 per person.


This is what I need to know.
Driver: How much are your medical bills?
Passenger 1: How much are the medical bills?
Passenger 2: How much are the medical bills?
Passenger 3: How much are the medical bills?

What are your UNDERINSURED MOTORIST coverage limits on your policy?
Who was wearing a seat belt? Does your insurance company's medical payments coverage pay double if you are wearing your seat belt?

I was involved in an accident, 100% not at fault, other driver ran a stop sign hit me in front quarter panel then bounced down my whole side sending me into a telephone pole.

I was injured - +-15,000
daughter 1 broken nose - +-2,500
daughter 2 minor abrasions +-1,000
friend, same +- 1,000

my underinsured motorists voerage 100,000 each person 300,00 each accident.

everyone had seat belts on, the policy doesn't say anything about the seat belts

My insurance company called with a settlement offer for my accident.

daughter 1 medical bills 1,444.00 settlement 1,700
daughter 2 medical bills 400.00 settlement 1,000
driver bills 11,000 settlement 8,494.47 with a 1,000 outstanding medical bill so actually settlement would be 7,393.47.

Not sure if I should accept or counter them.

Is all treatment complete? How is everyone feeling now? Are there any permanent damages?

They want to offer you LESS than your medical bills? Don't accept that.

I'm not sure what you mean. She doesn't say that the medical payments has already paid bills.

She said that only 1k of the 11k in medical bills is outstanding. PIP coverage usually pays directly to the doctors for medical bills so it sounds to me like the max on PIP was already paid, leaving only 1k owing on medical bills. The settlement amount is only needed to cover the 1k outstanding plus other expenses/pain and suffering/lost wages/whatever.
