Car accident Question


What is the name of your state? Florida


My pregnate wife was riding with a friend when another woman pulled out infront of them at an intersection and they hit her, the lady was totaly at fault she was cited with Failure to yeild. It has been almost a year and a half now of medical treatmentand she has finally been released from her treatment and we have retained a Lawyer to help us with this matter. When i talked to him he had found out the the lady driving the car that hit them had only 10K in liability and that my wifes friend only had 10k in liability. On our insurence we have Uninsured and underinsured motorist that can be stacked to Equal 20K. my question is, can my lawter file aginst both of their insurences and then file aginst our UM policy since both drivers carried very little liability insurence. Also maybe you can give me some information on what a "Tortfeasor" is and also what "Subrogation" Is.

"Tortfeasor"- literaly means wrong doer, the at-fault party.

"Subrogation"- when the insurance carrier attempts to recoup money on claims paid on behalf of their insured from the "Tortfeasor".

The answer to your question is, yes.
