Car Accident w/ Drunk Driver


What is the name of your state (only U.S. law)? Rhode Island

I was in the car with a drunk driver when he crashed into a tree. I was in the passengers seat and had also been drinking. The car was totaled and the driver fled the scene on foot (he has yet to be arrested). I was taken to the hospital and have back, chest and neck pain but did not break anything. Should I be taking legal action? What kind of compensation, if any, would I stand to make? Thank you.

Go right for his insurance company, (hopefully he carries state min coverage.) I'm sure your med bills and subsequent bills woul be paid. to the limit of the policy.

I don't know how much risk you will be said to have assumed by KNOWINGLY getting in the car with a drunk driver...

True, but still, the policy should pay her medical pmts as it was a car accident, and there were injuries. whatever the circumstances PIP (personal injury protection) will come into play, assuming he had the coverage.
