Hello,

I was in a car crash on 12/6/07 the other driver has admitted fault and her insurance has made me an offer on my car. It was totaled and I accepted the offer although it is less than half of what I paid for my car two months ago it seems like the best offer they are going to make and I really need to buy another car (they stop paying for a rental after they made their first offer) my question is after I accept the offer for the car they are sending me forms to sign and then hopefully a check. If I sign the forms accepting the offer for my car, will that affect my still pending medical claim? Also the insurance company is sending a Rep to my house to have me sign papers for my medical claim. I was told this needed to be done to release my medical records and set it up so they can pay the medical bills. Is this normal? And should I be signing any of these papers without a lawyer. I live paycheck to paycheck and really cannot afford an attorney at this time and I was hoping to settle this medical claim quickly so I can get on with my life. Thanks in advance for any assistance in this matter.

Read the release and make sure it specifies that you are only releasing the other party from future PROPERTY DAMAGE claims. Your injury claim is separate.

How much were your bills? If your case is significant, you will be able to hire a lawyer on contingency and he will get a percentage of your settlement.

However, they definitely need to obtain your records before they can offer you any kind of a settlement. Read the papers carefully. If you don't understand something, ask questions. If you're still not comfortable, don't sign and consult a lawyer (see above).

Thanks for the quick response. As of now the medical bills are only about $7000.00 (2 ct scans and an MRI w/ Doc visits) but I being sent to see a specialist next Friday and given more meds . I still have no strength in my left arm and they found a bulge in-between R1 and R2 or something like that (I can’t keep the medical terms straight) along with persistent headache and shoulder pain. I would guess my medical bills will continue to climb. How does that affect if I can get a lawyer? Also I’m currently stacking up the medical bills and not paying them with insurance (upon advice of my brother) but I’m using my blue cross/blue shield ppo for the meds(they are prescription) will that effect whether or not I can get a lawyer on that contingency that you talked about? Also I only have the state minimum for car insurance so I don’t think that will help me in this situation.

DEFINITELY consult a lawyer. You should not be considering settlement until your treatment is complete.
