car damage by road worker

4 days ago a road worker doing some paint work on the highway kicked the driver side of my car. i was exiting off the highway passing through cones set up by the road workers that very poorly marked the exit. i went through the wrong area, apparently, as did about 3 cars before me and the worker got upset. i called the police, but no report was generated because it was a civil matter. i was told to contact the company that the workers were employed by to get reimbursement for the car damages (estimated $1024). i suspect that I may run in to difficulty with the company as one of the men on the job is the owner of the company. if this happens would it be best to take the matter to my car insurance company or file a legal suit?? This occured in new york.

Sounds like the cops dont want to get involved.

Tell the cops.
Criminal damage to property is a crime. So is vandalism.
Try state police.
Then insurance company.
Then see a lawyer about small claims court action.
Or you can drive by at night and spill some paint.
