My car was hit while it was in the possession of a transmission shop for repair service. The shop owner parked my car on the street and it got hit by a truck. The insurance of the truck driver totalled my car for $2000. According to the KBB and NADA and other web postings, my car worth about $3000-4000. Also, I have just paid $1400 to have the transmission rebuilt.
Can I sue the shop owner for the difference if the insurance refuses to pay for the repair cost(est. body repair cost is $3500)?
