car hit by train

(Pennsylvania) While on the job, my son's car was hit by a train at a crossing that had crossing lights but where not functioning properly (have witnesses). We have been told by the train company that he will receive a bill from them for the damage he did for "hitting their train"!! Due to 'limited tort', we realize we cannot sue for pain and suffering. We would just like to know if there is any possible way to recover the value of the car. THANK GOD MY SON IS STILL ALIVE!!!

Just like you can't drive through an intersection with malfunctioning signal lights without checking for cross traffic, the same applies to train crossings. Trains are awful large and make a lots of noise so they can't be that hard to miss. And of course, trains always have the right of way. Thank God your son is alive but he will have to pay.
