Car Purchase Down Payment

I just reciently sold a truck and I am not a dealer. I had someone put a down payment on my truck in the amount of 200.00 which i was asking 500.00 for it. 3 weeks passed he still never came back with anymore money or was never in contact with me. What can i do? Can i resell the truck ?
Also would i have to refund his deposit if i sell it?

Yes, you can sell the truck. And unless the purchaser signed an agreement that stipulates forfeiture of the down payment, you will have to return the deposit LESS any costs you incurred trying to sell the vehicle again.
