Car totaled, now what?

My 18 yr old daughter's car was totaled in a store parking lot. No injuries. The other driver was a teen with a new motorcycle. He did not have the proper license to drive a motorcycle. Her car was in the wrong place at the wrong time, but the totaled amount that she will receive will just pay off the car loan. She will have nothing towards another car. Is this just her lesson that life is not fair or can we go after the other driver since he wasn't properly licensed?? We don't want to make trouble, but we don't have money to buy her another car or even to help her with it. Any suggestions/ideas would be greatly appreciated. Thanks.

The other driver's license has nothing to do with the settlement amount. You only get what the car is worth, nothing more. Lesson learned should be that cars are never worth what you owe on them.

Thanks. But can we sue the other driver to pay off her loan, since he was driving illegally? Do we have a case?
