we had a accident in georgia the car dealer holding the title is in georgia. the insurance co is in alabama . the car was totaled . we would not accept the amount they wanted to give us . they settled with the dealer. the dealer got the car and the money. we still owe about seven hundred dollars on the car.
this is a buy here pay here dealer. the dealer has now either fixed the car or is having it fixed. he has asked my wife to go ahead and take the car back and take up payments where she left off.
will then owe $4000.00 again on car.
Is this legal for them to fix a totaled car, then sell it to anyone. ive told her no way.

Was the car declared a total loss? If so, your obligation on that vehicle with respect to the loan ended and you are only required to pay the balance of the loan. In order to purchase it again, you should have to get a new loan, not continue your existing loan.

This dealer sounds very shady. Pay them the balance of the loan and get documentation showing you've paid it in full, including the accident settlement, and then go get your next car somewhere else.

selling car insurance company totals

We have never seen any paper work on the settlement. we just know what the insurance company offered us. to start with he was offering then a different car with no down payment which sounded good . Now i guess he wants them to take the wreaked car back, after he has fixed it.
someone told me you could not resell a totaled car, in the state of georgia . Anyone know about selling car insurance co totals ?

Do you really want this particular vehicle back? If yes.....Why!

You shouldn't be worrying about whether this car can be sold once it has been totaled.

Wash you hands clean of this thing. Pay off the balance of $700.00, go buy another vehicle at another dealer!

Quit dealing with this particular "buy here pay here" guy. He's sounds a little shady to say the least!
