About a week ago, some inebriated fellow at my school decided it would be a good idea to throw a cinder block at by car and smash out my windows. The school caught the perpetrator and he confessed. The school told me that he will be forced to pay restitution through the school disciplinary process. Unfortunately, I was forced to make multiple trips accumulating to about $50 in gas and was out my car for about nine days. The following questions I have are:

Can I charge for the entire amount or only for my deductible?
What is the standard compensation rate for each day without being with a car?
Are gas costs pertaining to fixing my car chargeable?
Should I file a civil case or continue through my school judiciary process?
Do I have a right to know the offender’s name?
What are the statues of limitations on this type of offense?

You can sue for whatever you want. Any amount above your deductible will have to be returned to your insurance company.

There is no standard. It depends what you can show were your losses.

Yes, you'll need to know it in order to sue him.
