Chapter 13 and auto accident

What is the name of your state? NV. We filed Chapter 13 in 205 under the old rules. In May of 2006 we were involved in a auto accident. We hit a car that turned in front of our car. We were not at fault. The driver of the other car had no insurance license or registration. Our own insurance is paying for the injuries I received. I had surgery on one knee and will have to have surgery on the other. I am having lots of health problems now. I spoke to our BK attorney about this and was told we could only collect $16,000 not including pain and suffering,if we decide to sue. Our auto was totaled and we have not been able to replace it.
We need help in deciding how to handle this. I spoke to one group of personal injury attorneys, and they know nothing about Chapter 13 and were unable to advise me at all.

Can anyone g:confused::confused:ive me any advice on handling this.
