Civic rear ended by dump truck at hi speed


What is the name of your state? IN

Yesterday I was rearended in my 2004 Honda Civic by a a dump truck on a US Highway. The driver said he wasn't paying attention and admitted fault. Originally the insurance company his work carries did not authorize a rental car telling me it could take 1 to 3 days to decide if he was at fault. Then authorized the rental car which did not cover the full cost of the compact rental so I'm haivng to pay for some of it out of pocket. I don't feel I should have to come up with any money out of pocket for anything - medical bills (Myself and 2 ofmy sons were in the car), car rental, etc. Any advice, guidance, direction or help greatly appreciated.

The injury lawyers will not take the case because our injuries were not bad enough. Now the adjuster for the Dump truck company is lowballing on values using CCC. They are wanting to stop car rental and have my car moved out of storage to lessen the costs. What is my recourse? I have NO idea what to do and the offer for the car is about 4000 lower then I could replace the car according to their valuations. Any advice, help or comments is greatly appreciated.

They are NOT required to replace your car. They are only required to offer actual cash value. Go to kbb.com, input your info, and see what you come up with for ACV. Print it, and show it to the adjuster.

Actually I have put in KBB with a value of 12,825 as well as NADA at 12,850, Edmunds at 11,589 and a car dealership that has my exact same model for 15, 495. That includes the high mileage discounts they take off due to the high mileage of the car. Other then high mileage the car was in excellant condition inside and out and I have all maintenance records to prove upkeep. He has a CCC value of 10,375.

I averaged his and mine and came up with an average of all of them put together and he said it was an unrealistic amount.
