Missouri - I was in a an autoaccident in 1998. I am considering trying to recover money for medical bills from a Minor (not now, but at the time of the accident) who was at-fault in small claims court. The minor was covered under Dad's policy (who refused to settle) and all I have is the then minor's Social Security number. Now that the other driver is not a minor, who do I name as the respondent and how do I go about gathering all the imformation about the respondent so that I can properly file with the Small Claims Court?

The Supreme Court ruled that a minor cannot be held liable in civil matters. The parents are responsible for the minor until age 18. If the minor is covered by insurance, the insurance company should be responsible and that is who you would have to take to court unless the father did not give you the insurance info. Did you file an accident report with the police? You are generally given only a certain amount of time (2 weeks where I live) and failure to do so may result in loss of any claims against the responsible parties. You should contact a lawyer over this matter. A half hour of a lawyers time should only cost around $35 (and if you were to sue and win, you could include this cost in the claim).
