Claim is denied due to lack of proof


What is the name of your state (only U.S. law)? TX
On April 25, my husband was driving his Honda on the two-lane road. He was on the right lane and there's an Audi on the left. As my husband was passing the Audi, the Audi suddenly came into my husband's lane. My husband thinks the Audi driver was either:
1. trying to make a right turn from a left lane, or
2. trying to u-turn in a tight spot and inadvertently got out of his lane
Either way, the Audi's front passenger side hit my husband car and caused a severe dent in the driver-side's side step and scratched the body. Police was not called because at the time the Audi driver appeared to be remorseful so they only exchanged information. Later my husband filed a claim with the Audi driver's insurance, he was told that the Audi driver now "adamantly denied" any fault and due to "lack of proof" they denied our claim. It will cost us more than $500 to repair the damage. That is not including rentals while the car is at the shop. What can we do? Please advise, thank you.What is the name of your state (only U.S. law)?

Sue them. You will still have a proof problem, but the court should be more neutral then the other party's insurance company who would have to pay.

Roll the dice in small claims court...however if it's your word vs theirs, you will have an uphill battle.
