collision with bear, can I sue the state?


What is the name of your state (only U.S. law)? Pennsylvania

I recently hit a bear with my car, and unfortunately I do not have comprehensive coverage on my auto insurance policy.

Wouldn't wildlife be considered state property, and if so, is there any way I can collect damages from the state? After all, if I were to walk into the woods and kill a bear without a hunting license, I would be prosecuted. Therefore it seems only logical that when a bear wanders onto a state highway and poses a threat to drivers, the state should bear some of the responsibility, since it is up to the state to manage and control the wildlife population.

If there is any possible way I can someone to help pay for the damages to my car (which was in no way my fault), I would greatly appreciate it.What is the name of your state (only U.S. law)?

It is not possible to sue the actual 'owner' of a wild animal, since that entity does not reside on this plane of existence. Nice try though.

If you sue the bear, expect to have a counter claim filed against you for the bear's medical bills and pain and suffering

And hunting a bear with your car is in violation of the hunting rules. Expect a citation from the Game Commission.

Poor Yogi I guess you could sue him and get his royalties from any cartoon reruns!!!

It is a funny question, but over here in Missouri, we have had lawmakers introduce bills that would make the conservation department responsible for insurance deductables for accidents resulting from collision with wildlife on public roads. These bills have never made it out of committee to my knowledge, but the debates are fun to watch.

These are the same people who want the deer crossing signs taken down because it's not safe for them to cross the road.

(Besides, even though deer can't read, they can recognize little silhouettes of themselves).

i've had my morning laugh.

this was my POV. man/woman hit bear. the bear didn't hit him/her. driver is at fault.

the bear's family should sue the driver.

i mean, seriously, if state property causes damage to my car, like a light pole or a median, can i sue the state for damages?

I knew someone that hit a bear once. It was a grizzly experience. He was driving a Fiat Panda. It was black and brown. He is now bi-polar.
