confused & frustrated


I just recently got into an accident. It was raining, I was on my way to work, I was going about 45-50 mph, I approached an intersection my light was blinking yellow, and the other person had a stop sign and also a blinking red light. I proceeded into the intersection, when she pulled out in front of me and hit my front passenger side. The insurance estimates the damages to be over $3,000 dollars. Now, what frustrates me is that her insurance company says that I am 20% responsible for the accident because there was a possibility that I was speeding, since the speed limit was 40. I feel that there is now way that I am responsible at all, she did not yeild to me when I had the right of way, it doesnt matter how fast I was going. She pulled out in front of me to late for me to avoid her anyway, even if I was going 40 mph I wouldnt have been able to avoid it. She even got a citation for not yeilding to me, so how am I partly responsible? Thus, they want me to pay 20% of the repair cost. I refuse to do so. I dont know what to do...help me out....

Your 'fault' was in your failure to respond to the 'blinking yellow' light in your lane. That is NOT a green (go) light, but a yellow (watch for traffic) light.

Here is what a blinking (or flashing) yellow traffic light means:
"If you are approaching a traffic light which is blinking yellow, it should be treated as a Yield sign. Slow down and proceed through the intersection with caution, but do not stop."

This means that you have SOME responsiblity to make sure that the traffic is clear which you clearly did not do. The insurance company has 'decided' that your failure to follow the traffic laws was a 20% contributory factor to the accident.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!
