I was in an auto accident 6/23/2000 in Indiana. I was rear-ended and suffered a compressed fracture of my T11 vertebrae and was in a brace continuously for 3 1/2 months. I hired an attorney a week after the accident, when I found out from her insurance adjuster a few days earlier that he still has not been in contact with her about the accident. I have tried to keep close contact with my attorney's office and did a lot of the paralegal work myself because they were procrastinating. It took them 1 1/2 months after I notified them of my release from the orthopedic surgeon's care and threatened to get another attorney for the attorney to finally speak with me personally and do a demand letter to the insurance adjuster.
I received an offer of $14,000 in a letter from attorney. I didn't agree and I initiated getting a letter from my doctor. The doctor sent it directly to the attorney and the attorney just sent it off to the adjuster for case reconsideration. The attorney never even contacted me to inform me that he received the letter or its content. I then receive a letter from my attorney of second offer, $15,000 and the attorney saying the doctor's letter wasn't a very helpful one and what his fee will increase to if I take it to court and that it won't get heard in court for at least 18 months. My question is: Is this normal procedure and do I contact the President of the law firm of the handling of my case, switch attorney's, get my own specialist opinion of my medical condition and go for a third offer, and what could the ramifications be with the insurance company if I did so at this point?
