Consumer Rights


What is the name of your state? What is the name of your state? Texas

We were hit by another driver in November. The accident report lists the other driver as responsible for the accident. Their insurance company is not cooperating. Every time we provide the "one thing" they need, now they need something else. Does anyone know where we can find information on how long they have to settle our case or what our rights as consumers are? In hind sight, we should have gone through our insurance company. But now, 46 days after the accident, we have an enormous rental car bill, much higher than our policy's allowed maximum. The insurance company whose client hit us has been unresponsive and we have had to call numerous times with very little activity being done by them. We have a totalled car, a huge rental car bill, my husband's small business has lost work opportunities because of our car situation, and I'm not sure where we can turn for answers. I went to the Texas Department of Insurance and there was a consumer's bill of rights. But it really didn't have a lot of definite time frames or requirements. If you read that bill of rights, it looks like they could drag this out indefinitely. I'm paying for the rent car out of pocket, and am really afraid we'll never get anything out of this insurance company. It seems it should be illegal for an insurance company to do this to anyone. Can anyone provide info on where to look for guidance? I hate to hire a lawyer, but I suppose that's the next step we'll have to take.

I have no idea what amount of information that you have amassed up to this point but let me point you in a direction which may help.

If you believe an insurance company has treated you unfairly, call the Department of Insurance at 1-800-252-3439 (463-6515 in Austin).

Sometimes, however, there is no substitute for a lawyer to get people's attention!

In this case you are not a consumer and therefore have no "consumer rights". You are an injured party and have the right to sue the person at fault, but you have no contractual relationship with their insurance company. It would probably be wise to turn it in to your insurance carrier and get your car repaired or replaced as soon as possible, as you do have a responsibility to mitigate your damages.
