Daughter in accident


What is the name of your state? Virginia Daughter age 15yrs, was a backseat passenger of a car that was t-boned...due to the neg. of the driver of the car my daughter was riding in..She sustained a broken femur..permanant rod in leg..another surgury for glass embeded in her arm.another to remove a screw in her leg due to a complacation...she still has 3 more screws that might need to come out in future..my question is for the laywers as far as an opinion. the driver of the car has travelrs insurance....We did retain a lawyer who says as far as future med bills my daughter will have to start saving up for them..Is this true..Also her medical bills are almost $40.000 not including the helicopter ride..What happens to the medical bills if it's over the insurance limits?Also how will they handle the claim since my daughter is under 18..I have read the past posts but dont see questions.. that pertain to my questions. This lawyer doesent answer anything i ask him he just says let me handle it ...should i look for another attorney?

what is the policy limit on the other vehicle? what is the med pay policy limit on the vehicle your daughter was in (if it had such coverage)? Did you have medical insurance at the time of the accident and was your daughter covered?

The lawyer will not answer any questions for me...i was told by the social worker at the trauma hospital that my daughter was taken to that the policy limits on the persons car was 100.000..as far as med pay i recieved a copy from my lawyer to the insurance company demanding payment up to 4 x of coverage...be made payable in his name and mine..thats all i know, we had a meeting i tried to ask him these questions and he would not answer them..so i really dont know anything ...huh it's almost like i dont have an attorney...as far as my health insurance we have an HMO plan.....who paid $4,500 of the bills only...

Im sorry i forgot to say,i was told not to contact the insurance company,I've never spoke with them....I'm wondering besides my lawyer how would i get the information i need to answer your questions.

DROP THAT ATTORNEY! Any attorney that wont even ask you questions sounds like future headaches if any problems come into the situation. Heck, with your current lawyer i think your gonna have to hire another lawyer just to talk to him and report back to you. Do you and your daughter a favor and see an attorney.

Im dont know the laws of your states but in most the law allows the statue of limitations (the time limit/clock that lets people sue each other in) to be put off until after the age of 18 plus some time.

Im curious, how much did that helicopter ride cost?

Thanks Alex for the reply ..we are still waiting for Medstars response to our billing questions..its suppose to be a little under $10.000 according to the social worker at the trauma center....
