Daughter in auto accident


What is the name of your state? Montana

I had put full coverage insurance on our car.. now my agent says it's not covered for Collision.. Why would I have full coverage and pay the price and now it's not covered. I told him FULL coverage..
now I find out my son has been driving with no insurance on his toyota truck.. my darn agent never filed it with the Allstate Insurance.. he gave me the receipt when I went in to put the truck on...
I'm upset with this agent.. our car is totalled.. not a cheap car.. worth over 7,000...
I have full coverage on my 1994 ford explorer which is worth nothing.. but well worth having full coverage..
What can I do?
I'm just glad my daughter and her best friend survived the accident..

There are red flags here. Do you have a copy of the check or any receipt showing you paid f/ collision coverage on this car?

When you add or change coverage Allstate should have mailed you a copy of your new policy. What does this say? Do you have collision coverage on there? Were you even mailed a new policy? If not then it wasn't turned in f/ whatever reason.

I'm not saying this is what's going on here but a common type of insurance fraud is agent fraud. Say you decide to add collision coverage to one of your cars. You pay the agent, he keeps the money instead of sending it into Allstate. The risk the agent takes is that you don't have to use your collision coverage that year and he walks away w/ your money. They will also tell you you never added it to cover their own ass. You need that returned check or receipt to prove he was actually paid.

If you do have proof you paid f/ collision coverage and it was not added, Allstate should cover you. Then I would turn this claim and your agent into the National Insurance Crime Bureau (NICB) to be investigated f/ possible insurance fraud.

Lastly, claims adjustors have the right to do an unannounced audit on the agent if they suspect this. Let the adjustor know whose handling your claim about this as well.

I had went to my agent today.. and sat and sat and didn't give up.. Told him I had called him in Aug. 2004 and put the full coverage on the vehicle.. I sat and sat and over and over told him the same story.. while all this time he looked and called and kept it up.. then he finds a note, dated 8/21/04 our vehicle, our policy number and stated I wanted full coverage... so guess what... Now I have to pay for the collision since 8/04 but looks like my car has full coverage and proof that I wanted it..
He says I wouldn't leave... so I guess I did great by standing my ground!!!!!
