Dead tree vs RV

While our RV was parked at a private campground that we belong to, a dead tree fell on the RV, approx. 90' tall tree. RV was totaled. Ten minutes later and we would have been in the RV and our truck would also have been totaled. Our ins. Co. covered 82% of the depreicated value of our RV. We believe that the Campground Org. should be held liable for their gross negligence since they have been told that they should cut down the dead trees in the campground. Their excuse is that they don't have the money or the resources to do so even when members have tried to volunteer to help cut down the trees.

DO I HAVE A CASE? WE HAVE LOST A RV & THE CAMPGROUND ASSOC. HASN'T EVEN CALLED US. This happened on Oct 12, 2007. No wind or rain to cause the tree to fall. Tree was JUST DEAD.

Your insurance covered the value of the the RV, you appear to have been made whole.

What might have happened is not a damage.

If the park is at fault, the insurance will seek top recover from them.

Why did they only cover 82% of the value?

Can you PROVE that the park was aware that THIS PARTICULAR tree was dead and posed a danger? If not, you're going to have a hard time proving negligence.
