| Dealership sold me a used car with no title... I live in California.
In April 2005 I purchased a used car from a dealership. I paid for them to handle all my DMV paperwork, and was told that my title and registration would arrive in the mail in about three weeks.
It has now been nearly five months. I've called the dealership five times, and finally learned that there is a signature missing from the original owner, and they can't transfer the title to my name until they track him down.
I submitted a complaint to the Better Business Bureau, after which the dealership called and offered to give me a different car or refund my money. HOWEVER, since purchase the car has had major mechanical problems which I had to pay over $1700 out of pocket, and the dealership refuses to refund me that money.
My thinking is that if they hadn't sold me a car without a title in the first place, that I would never have had to replace the transmission. Furthermore they are getting back a better vehicle than they originally sold me, as the transmission has been entirely rebuilt.
What are my rights in this case? Is the dealership legally required to reimburse me the transmission money?
