I have a question


What is the name of your state? Indiana

A painting crew oversprayed my property and my vehicle while painting trim on a house being built next to me. The crew was painting on a day with 36 mph winds and 3.6 inches of snow. The insurance company is willing to pay 100% on the damage to the house and property but is only willing to pay 2,100 dollars on my truck because it was a '97. I just purchased that vehicle on November of 2003 and the damages occured January 2004. I have two estimates, one for 3500 dollars and on for 4700 dollars. The 4700 dollar estimate is after the insurance company tried cleaning the paint off and causing further damage, taking the clear coat off and leaving scatches and swirls in the paint, not to metion there is still paint all over my vehicle. Do they have the right to deny paying 100% of the damages? I also sent them a letter from the dealer stating and signing that there was no paint flaws on the vehicle when purchased 2 months prior

I paid 6,600 dollars for the truck cash at a dealer nearby. Does that really matter though??? I bought the truck in excellent condition. it had 119,000 miles on it but it is a v8. My deal is, why should they only be able to pay 2100 dollars for something when their client was really negligent. My estimate is for 4700 dollars.

I was interested in the total value of the truck relative to the cost of repairs. You are not obligated to accept the settlement. Check the small claims limit in your state and file suit against the contractor either there or in circuit court.

However if the insurace company has a shop that is willing to do the repairs for 2100 then that is all you will get.

i was under the impression that indiana law says that you only have to take it one place to get an estimate? so it doesnt matter about the insurance's shops . is this correct? good news though, the builders are talking with the insurance company now to pay the total amount. I called a local news station for help and they started putting the heat on the builder to do something.
