The "innocent" party is the one who is usually wholly within his own lane of traffic.

The "guilty" party is the one who crossed into someone else's lane of traffic or hit a vehicle from behind.

Sometimes the police report is helpful and sometimes it is not.
 
If I can add to SJ's response...

The insurance company does not have to agree with what the police report says. Nor does the court system. In other words, just because one entity (for example, the cops) say someone is at fault doesn't mean that another (for example, an insurer) has to agree with them.
