| didn't cause an at fault accident State: Pennsylvania
Hello! I was recently in an auto accident (no injuries, minor damage). I had pulled out of a parking spot at a store, and had to re-back up in the isle due to the angle of the lot and to avoid a car waiting to pull in, and when I did, I hit a vehicle that was backing out of the spot next to me. I wasn't cited for the accident, but was considered "at fault". Here is the kicker. The other driver has a suspended license. The cop couldn't even cite him because the accident was on private property.
I need to know the right-of-way laws in Pennsylvania. Isn't it the responsibility of the person backing out of a parking spot to make sure the way is clear? How is this accident my fault? And how will this be affected by his suspended license?
I don't care about paying for damages or suing for anything, but I don't want my insurance company to "blame" me for an accident I didn't cause. (I was in another accident over a year ago, a drunk driver passed school buses on a one-lane street, and hit me while I was making a left-hand turn onto a cross-street, but I was charged with the accident because of some freaky Pennsylvania law about all left-hand turns being illegal, so my insurance rates are quite high.)
What are my options here? I'm still in the initial stages of this particular claim, so I don't have my insurance company's final determination. I just want to be as informed as possible.
