Diminished Value


What is the name of your state (only U.S. law)? VA
I was involved in a car accident NOV08. The at fault party didnt have insurance, so all my claims are going through my insurance. Well with that said I put in a diminished value claim. The insurance company is giving me a low figure. So I did some research, and from what I found is very different. I had it appraised by a independent appraiser also and the report shows the insurance company is way off. I asked the insurance company for a copy of what they had and they wont give it to me. I was wondering if anyone had any advice on how to talk to the insurance company or what I could do.

Send them a copy of your independent appraisal and hope for the best. DV claims are hard to prove, especially with your own insurance company, unless your policy specifically covers it.

I had a problem a few yrs back with Ins.Co trying to total a car.At the time,the Kelly Blue book,the N.A.D.A. showed increased value comparied to the Ins.estimate.But ,I believe what truly helped was ,I went into a few online dealers and found the closest car ,in yr,mileage and optional equipt,9I couldnt get a comp.with a car as nice as mine)after submitting ,the Ins Co took my lowest comp.then deducted my deductable.I believe you need to do the homework.Worked for me.good luck
