Diminished Value and car seat replacement?


What is the name of your state? Texas

I was involved in a car accident last month and I am a third party in the situation. I was going through an intersection, my light was green and this lady pulled out from the u-turn and hit the driver side of my car, she was in an expedition. Her insurance only offered me $2100 at first for the damages to my car, and finally this week they have agreed to pay for the total cost of damages, $3000+. It was like pulling teeth since the lady that hit me never called or still has not talked to her insurance company, luckily a called the police and he filed out a report and gave her a ticket for failure to yield. So my husband pays for an appraisal company to get the diminished value for my car and they send the car insurance company the report and then the car insurance company leaves me a message saying I need to either sell or trade in my vechile to get the diminished value. I never heard that before. You can find out the value without trying to do that. Its a 2005 Acrua TL, Ive only had it since September and although the are repairing my car and had to replace my driver side door, its value its still not the same as pre-accident. The apprasial place has suggested we hire an attorney, no help from them, all the pretty much do it write a report, gee I could have done that for free. Also, my sons infant carseat was in the vehicle so I had to replace that and we sent the insurance company a copy of the receipt and they say they need the receipt for the car seat that was in my car, which we do not have since it was a gift. Anyone know or have filed diminished value and can give me some tips. I have looked a lot up online and what should I do about the car seat? This whole situation has been a pain.
