I'm looking for any insight available for a diminished value claim, potentially against my own insurance company as I was hit by a driver with no license/insurance. I have uninsured driver insurance in my policy.

I know Kansas has the legal precedent set forth for this to be a valid claim, (Venable vs Import Volkswagen INC 1974) but I'm looking for any specifics on the most widely accepted way to qualify the claim.

Thoughts?
