| | | Disabled ticket in private lot? Austin, TX
Basically, the situation is that I a got parking ticket today for parking in the "disabled spots" of my own parking lot at my fraternity house. I'm pretty confused about how we I can get ticketed on what we at the house thought was private property, and if the disabled spots have any validity in the area, esp after almost three years of seeing actives occasionally parking in those spots without hearing of any incident, there no disabled residents in the house, and us being able to control who parks there (but apparently not where within that lot) etc, etc. We suspect since the Constable's Dept which issued the tickets hires volunteers to issue tickets, there's a slight chance it may be a mistake, but since the Constable won't return my calls its hard to determine..
anyway, just hoping maybe you could provide some insight on property law, or offer any contact or info that could help me determine if I need contest this, bite the bullet and pay the fine, or in the least warn other actives and change our parking rules at the house. |

| | | You can't park in a handicapped spot if you don't have a handicapped tag (license plate or mirror tag). Period, no matter where the spot is.

| | | it's funny how I constantly get that 2D way of looking at it; that a completely victimless incident should still be treated as a justifiably punishable crime just because a sign told us it was. There wasn't a single chance I was taking a spot from a handicapped person who wanted to park there, it was a PRIVATE lot. So why should I be punished? At the very least, I was hoping someone could provide some advice on how to go about removing the signs on our own property, since it doesn't make sense to continually not use two spaces in an already crowed lot, simply based on legality instead of common sense. |
