I was involved in an accident two years ago where it was clear that the other party was at fault and I sustained significant injuries. He had insurance. My PIP coverage had run out and I was continuing to incur medical costs. I was told that I needed to retain a lawyer to recover the medical costs paid out. The lawyer was not doing his job so we severed the relationship. My trial is still scheduled and I am currently unrepresented.
What I would like to know is:
1. Since it is clear that the other party is at fault, are they responsible for all damages (including medical) in relation to the accident? What laws state this?
2. If I had not filed a lawsuit, would they have been obligated to pay the medical bills?
3. Since I did file a lawsuit, did I wave the right I have for them to pay my medical bills?
4. If I dismiss the lawsuit, do I wave my rights to recover costs in relation to the accident?
5. Will the insurance company still need to settle with me if the trial has been dismissed?
