I recently wrecked my car. I was pulling from a parking lot, and didn't see a car coming. When I saw him, I stepped on the gas. I then lost control, and overcorrected. In the process, I hit a tree. I panicked, and left the scene. I then reported the car stolen and filed a claim with my insurance company. The insurance company took a recorded statement, and sent out paperwork. About a week later an investigator came out and took another recorded statement. Within a couple days of this, my concience got the better of me, so I went to the police station and admitted that I had been driving the car and admitted to filing the false report. I then called my insurance company, and admitted to them that I was driving. They took another recorded statement with me telling them what happened. The claim representative told me I would hear back from them the first part of next week. That week passed, and finally the following Monday, I get a letter from them, refusing to pay the claim due to false statements. I did make false statements, but never signed any papers at all. I have had people tell me nothing is legal unless it is signed. In my policy, it does state that if I don't fully cooperate with them, they don't have to pay said claim. Do they have to pay the claim? Also, the car is totalled (would cost 14k to repair, and is only worth 20k according to the insurance adjuster). Under my loan agreement, I must keep full coverage insurance on the vehicle over the course of the loan. I can't really see paying insurance (especially to this company). What am I supposed to do?

| You can drop the insurance and let the creditor purchase insurance to cover the loan, you will be responsible for the premiums though. It's all in your loan agreement, it's time to read the fine print.
You also have to worry about potential charges of filing a false police report too. Now might be a good time to start looking for an attorney.

You've admitted to committing a class 6 felony.
An insurance company is not obliged to pay to repair your car. If the damages are a substantial portion of the value, they'll just pay you for that value. You don't have to worry about paying insurance after that as you won't have to, nor will you have the car. Hopefully the payout will be enough to pay off your loan. If not you're on the hook for the balance unless you have gap insurance or your lender rolls that in as an added benefit. |
