I am assuming since the other driver doesnt have insurance due to financial reasons. If you were to take them to small claims you may win the case, but if they has no assets (and if unemployed) would not have any pay earnings to garnish. Have you contacted them to see that they plan on doing to help you with this problem?

Looks like you are out of luck in this case. I was hit once by a non insured driver and I found myself paying $500 out of my own pocket for the deductible. the other driver was a mexican national and I soon found that he quickly disappeared. I never recovered that money. I quickly learned of "uninsured motorist" coverage which generally only costs a little extra every month.I know this doesnt help you now but have you thought about increasing the insurance on your coverage to help prevent this from happening again ?
