Were you falsely arrested for spitting on the sidewalk just so that they could get you down to the station in order to beat that murder confession out of you? Sure I could see it.
I don't know the legal aspects of it, but the way you put it doesn't make any sense to me - why not charge you with the higher offense right off the bat?
