Extremely injured by 18 wheeler


In November of 2001, my mother, who lives in Alabama, was doing some shopping and driving my car, when she was about to turn off the highway into a parking lot. She had slowed down and had signaled that she was going to turn off well in advance, but an 18-wheeler owned by a nationwide trucking company struck her from behind, ramming her across the road, over a culvert and into a ditch. The car was completely totaled, and my mother suffered from a concussion, sprained neck (whiplash), and has several pinched nerves and damaged vertebrae in her spine, all due to the truck driver’s negligence. Her doctor also diagnosed her as having lost most of her sense of smell due to her head injuries, and she’s going to have at least one surgery that we know of so far, on her damaged vertebrae. In spite of all this, her doctors and her lawyer seem extremely reluctant to do much of anything. Her doctors keep scheduling more and more appointments to see how much “better” she’s going to get before they do anything, while she can barely get out of bed due to extreme back and neck pain, and loss of feeling in her arms and legs. She can barely sleep at night, as she has so much pain that she is awakened every few hours. She has no income now whatsoever; she can’t work, yet she doesn’t qualify for unemployment because you have to be able to work to get unemployment. She can’t even get disability because a doctor told her she had to wait a year. Is there anything a person who has been so severely injured can do to get help now, or is she going to have to wait 2 or 3 years until a judge decides to hear her case?

Your mother sustained the injuries only a few months ago. Not enough time has elapsed for the considerable inflammation and swelling to subside. The body often has remarkable recuperative power and her doctor's are wise to be patient before attempting any surgical repair. Too soon and they might make things worse. The first rule in medicine is, "Do no harm".
The road to receiving "disability" is frequently difficult and requires the opinions of several doctors and a long round of appeals.

i hope they have her in physical therapy(doing something for her pain, pain management clinic) has she had a emg and a mri done yet. but the rule thumb seems to be 4 to 6 months for swelling to go down. if some of these tests are done too soom the get a inacurate reading. but she should be getting loss wage payments from the insurance co along with medical bills pd
