Failure to yield? V.C. 21803


What is the name of your state? What is the name of your state? California

I was involved in a recent accident. I had a green light to turn left across two lanes of oncoming traffic. I pulled into the intersection as the oncoming lane closest to me was clear and stopped, waiting for the far lane to clear.

I was hit by an oncoming car that I hadn't seen anywhere. He could have been masked by the other vehiclem could have pulled out to pass him, could have pulled out of a driveway, don't know.

The driver of the other car told the police that I HAD stopped but that I was in front of him and he couldn't stop his vehicle.

The short of it is, he was cited for no insurance, I was not cited for anything but the police report says I was at fault for failing to yield V.C 21803 (a)

But I DID yield, I was stopped, and part (b) of that same section says that once I'm in the lane other drivers must yield to me.

What do I do? I don't need the point.

what lane were you in when you got hit? How long had you been stopped in that lane before getting hit?

I was about in the middle of the intersection, just a bit into the closest (and clear) southbound lane. I had been stopped for about 2 or three seconds. I was struck on my right front almost head on. Car was angled about 15 degrees. I was only waiting for the last car to clear the farthest lane.

Looking up north beyond my intersection to the next I could see the light turn green for the next wave of southbound cars. I couldn't remain there long.

the police said something about the debris field not being near the center of the intersection. Well, duh! I had picked up my stuff and gotten my car out of the middle of six lanes of Christmas shopping crazies already honking on a dark, rainy, and stormy night. His car dumped it's trash where he came to rest. The rest was migrated by moving traffic. It was 20 minutes before they showed up.
