My dad had been burning wood on his Florida property and some of the ashes had blown into his woods. Afraid of a fire, he called the local fire department(may have been volunteers). They came and started to back up, my dad thought they were backing straight so he turned his back, but they curved the truck and knocked him down, running over him. He died about 6 weeks later. Do we have a wrongful death claim,even though they may have been volunteers? If so, would the executor of the estate(which is his attorney) file the suit? Would any money go to the heirs mentioned in the will? Do fire departments have insurance for this type of thing?
