At fault driver has no insurance!!!

Ok, here's the deal.

My fiance and I were in a wreck a few days ago. The driver that was at fault has NO INSURANCE. My fiance's car is ruined...the front end is absolutely totalled.

My fiance and I want to sue the other driver. I talked to someone at work and she said that we're basically out of luck since the other driver has no insurance and that we probably won't get any kind of compensation. So, what now? Is this other driver going to get away with ruining a car AND causing pain and suffering?

I am just livid over all of this. Any comments/advice would be appreciated.

Does your fiance have coverage on his insurance under "non insured driver"? He can get the car fixed via his insurance.

OR he CAN sue the other driver personally. So, basically to do this, you need to get an attorney to rep you. I think the reason the person said you are out of luck is one of money issues. Do you think this person has enough money to pay you?
