at fault driver not returning calls

What is the name of your state? Arizona

I was in an accident a few days ago. I was not at fault and the other driver after calling in her initial claim now refuses to return her own insurance companies calls in regards to the claim. I am now without a vehicle without a rental car and unable to get to work due to back pain (went to the ER) for three days. If she does not contact them within 30 days are they automatically responsible? If she is deemed at fault by the sherrif and issued a citation how does that not warrant automatic responsibility by the insurance company? Would I be smart to hire an attorney? Or do I give them their 30 days?
