At-fault party's insurance company won't pay 100% damage


Pennsylvania.
My car was crossing the street to enter the gas station on the other side of the street when the other car emerge from off the side of the road into opposing traffic and hit my car at the entrance of the gas station. Police report shows the other party has violated Penn. vehicle code PAVC3344 - failure to stop when entering from alley, drive way, or building. Yet the other party's insurance company is willing only to pay for 50% of the damage. The other car hit me and this can be borne out by the pattern of damage on my car. It will cost about $4000 to fix the car. I only have liability insurance so I can't file a claim against my own insurance company.

Looks like i have two options:
1. Hire a lawyer or
2. Sue on small claims court.

Which is a better avenue. What are my chances?

#2 on such a small amount. And quit letting your car get gas on it's own. There should be someone behind the steering wheel.
