I've posted about my accident here in the past 2 months. I was rear-ended by another vehicle in 3/08. Went to ER that day, am currently treating with a chiropracter. Allstate is the insurance of the at fault party. They took my recorded statement of my account of the accident about a week after it happened. Today they just called me again to "see how I was doing," and told me at the beginning of the conversation that it "may be recorded." I am presuming that it most certainly was being recorded. I was pretty close-lipped during this conversation, and told them to talk to my chiropracter if they needed any information on my injury. The adjuster on the case wants to call me back in a month to "follow-up to see how I'm progressing."
Am I obligated in any way to continue with these types of phone calls? I do not have legal representation as of yet, as was hoping I would not need to, but this seems extremely inappropriate (and bordering on harassment).
Your advice would be appreciated. Thanks! |

| | | It's the claims adjuster's job to keep tabs on how the claim is going. All you have to say for now is you're still treating, and you don't know when you'll be done. You should be having regular consults with your doctor about the progress of your treatment, so you should have an idea when you're close to done. Basically the adjuster just wants to know how far out to diary the file. When you have an end date in sight, then you can let them know about that, so they can be prepared for you to submit all your records. |

| | | It's typical for adjuster to call you monthly to check on you. In my case, I don't even answer the phone anymore when I see their number on the caller ID. I normally call them back late at night and leave them a voice mail such that treatments are still needed for few more months.
If they require recording conversations, I stopped and drop dead. I would respond in writing, so you know what you replied. |

| | | they asked if they could record me, I said no, and that ended that. I think the laws is if they do not notify at the beginning of the call, they must have a beeb every 30 seconds. They can record all they want, but they can not use it in court if they do not follow the laws regarding recording a converstion. |

| | | Thanks to you all for responding ... I guess I don't have a problem with them keeping tabs of my progress ... just about the recording, but loved the idea about calling back at night. They always call our home # to leave messages, so never any need to avoid the call as I'm always at work.
