in Utah.

I was in a small fender bender in May during an off-roading expedetion to Moab, Utah. I rear-ended a girls truck when everyone slammed on their brakes, I slid in the sand and dented her bumper pretty good. No-one was hurt and no police were called or reports filed. I told her the day of the accident I would try and fix the dent for her as I have experience doing that, or that I would try and find a replacement for her.

Two weeks later she finally got the bumper to me as she said she would have her boyfriend remove the bumper at the high-school auto shop. She had my brother who also attended the same class bring the bumper to me to try and fix. In the mean time I was calling for prices on new bumpers and trying to find a used one that wasnt all beat up as well.

After attempting unsuccessfully to fix the bumper I resorted to just finding a new one, since I was also unable to locate a used one anywhere. She had said before that a used one would be fine as long as it looked decent. I was unable to even find a new one in stock anywhere, and it would take at least one month for a new one to be shipped here. She was leaving town without the truck to work at a Boy Scout camp in Jackson, Wyoming. I had no contact with her and didnt even know her last name. I found out through my brother on May 21 that she had told him (Steve) in front of my other brother (John) and two other people that she was leaving town that day and for me to not worry about getting a bumper as her parents were going to sell the truck that summer and I should just not worry about it.

Now three months later she's back in town and telling me that she has changed her mind and want's me to buy her a new bumper. Well she hasnt contacted me directly she has had her boy friend tell my brother Steve since they worked together to relay the message. She finally called last week when i wasnt home and told my brother John to tell me she called. Not what about, just that she had called. I got a message on the answering machiene on Wednesday stating that she has been attempting to contact me for the last three months (which is NOT true) to tell me that she wants a new bumper and her father is upset and wants to take me to small claims court.

I feel I am no longer responsible after she told people to tell me not to worry about the bumper anymore, and am also somewhat upset that she never tried to contact me until this last week. Never once since the day of the incident has she contacted me until Wednesday, all was done third party.

I could use some legal advice as to if I am responsible or not. If I am I will gladly pay for it and be done with the whole thing. I just do not feel it's right for her to come back after three months and change her mind.

Your advice would be greatly appreciated.

Thank you.. sincerely

Rob

The girls father is a parole officer and say's he'll go to court and say he's heard his daughter speak to my mother on the phone this summer to let me know about wanting a bumper. This is not true. We have caller ID and an answering machiene there have been no messages until last thursday. He also claims he has 16 teenage witness that i hit here and said i would fix the bumper, yet there were only a total of 8 kid's who saw it. He claims the Teacher from the class saw it, which also is not true. I feel really cornered by someone who say's his word is gold in a court room and I have no options but to pay for the bumper. I have until tomorrow afternoon to reply. This is all very sneaky I feel. Utah is also a no-fault state, I thought that meant she file's with her insurance company. There has been no exchange of any information. Any reply would be greatly appreciated.
