I was in a car accident about 6 months ago, when I ran into a cow in the middle of the night on a dark road. My car was totaled and I lost a lot of money since no one confessed to ownership when approached by police. I want to know if I can still proceed with a lawsuit against the county even though 6 months have passed.

My response:

Assuming that you were still within the 6 month's claims period, on what grounds would you claim that the county was negligent - and that would fall outside of the Governmental Immunity statutes?

Also, unless you have a legally cognizable reason for having allowed the Claims period to expire, then no, you undoubtedly wouldn't be able to sue the public entity. Check with a local attorney to make absolutely sure.
