I'm almost ready to sign a release sent to me by Gourtons but I'm troubled. Taking a step back when I entered a Mc Donalds establishment in South Jersey and ordered a Fillet fish sandwish which came with bones.
one of those bones became lodged in my throat. I claimed Emergency room visit, lost of earnings and pain & suffering. They offered $500.00, the hospital bill was $332.00. No blame was accepted although they acknowledged that this incident did occur.
Why would this release be pertaining to New York State Laws, should I seek further legal advise and finally can any learned person in the WWW help me or ease my nagging doubts ?

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

First and foremost, NEVER give names of people or businesses.

Second, this is what is called products liability and vicarious liability. At the restaurant, you ordered a fish sandwich (hint, never order fish from fast food places) that had a bone in it. Now, typically, a bone is not foreign to fish -- fish have bones. However, it may be foreign because of the way the restaurant makes it or advertises it (ie, processed fish). They buy it from the big fish dealer --> who may or may not guarantee such an item being in your sandwich. If they offered to settle, it may seem they are settling for way too little. May I suggest you seek recovery from the restaurant, not the fish manufacterer.
