Fire damage


The situation:
My car was parked in an off street parking lot. The car next to mine caught on fire damaging the front end of mine. I have no comprehensive coverage on my car so my insurance does not cover the damage.
The insurance of the car which caught on fire says the driver is not liable since he did not set the car on fire, meaning they are not responsible for the damages to my car.

Is this possible? Can the insurance company waive their responsibility so easily? Is there anything I can do to get my damages payed for?

You have refused to list your state.

You can try filing a lawsuit against the owner of the other car. I have no idea what your chances of winning might be. You can talk to a local attorney about it.

Insurance company isnt "waiving its responsibility", it's saying there is no negligence on their insureds part so you dont have a case.

What caused the fire?

Sue the other guy.
How does the insurance company know he didn't set his car on fire?

Sounds ridiculous, but. In NC a guy deliberately ran into another guy and his insurance didn’t want to pay. Stated it wasn’t an accident. Court ruled they had to pay. Ridiculous? But….Give it a try.

It's very difficult to prove an intentional act.

I filed a claim. They will send notice that they will not pay for damages. Progressive insists on the fact that since the driver had nothing to do with the fire, he's not liable.
Claim rep gave another example to explain: If driver on highway is hit by a stone thrown by kids over a bridge and driver crashes into other cars, he's not liable because he did not cause the accident and there was no negligence involved.
My current insurance (i have no comprehensive) says they should be liable since that car was the originator of the damages on mine. But I have no other resources to back my claim.

The insurance company (progressive) made an investigation on the origin of the fire and found nothing. Carmaker (honda) also found nothing wrong. Both concluded someone set car on fire and Fire Department agreed. They say driver was not the one to set on fire.
So far, my only resource is a Lawyer but I feel like I would spend more than what my car is worth.

That's a shame, but sometimes bad things happen and no one is liable for it.
