What is the name of your state? Florida
My daughter was in an accident in which she was not a fault. The responsible parties insurance company has indicated that the only option she has is to release the car to them and they will pay BlueBook value or she can keep the car and be given a minimal amount for the car but can only use it for parts , not have it repaired. They have stated (nothing in writing) that the car is a total loss. Do we have to accept this; what other options do we have. The car was in excellant condition prior to the accident (1994 Cutlass Supreme 2Dr Coupe-one owner)

The insurance company has present 2 of the 3 options available to you. The third is to retract your claim and repair the car yourself. The insurance company is just following your state's laws.
