Furnace without filter for 6 yrs Renting


I just found out recently that the flat I am renting has a gas furnace that has no filter.... there isn't even an area to put a filter in!! The Lanlord installed the furnace new just before I moved in nearly six years ago. I have had a few problems with the furnace breaking down. Now, what I would like to know is, I have always not felt well during the heating season, I have asked him to change the filter and he has sad that he does. I am always sick in winter and the air seems stale. Had floods in the basement as well so having a changed filter was very important to me for my health. Mold was growing in the basement as well. He told me it was changed when I asked him. A building inspector was here and could not find the filter. There is no spot for a filter, the Landlord put the vent system in without constructing a filter area. I am very angry about this. He outright lied to me several times. As to why I didn't change the filter myself, well I spent several times looking at the furnace trying to find the filter and could not, it's gas and I didn't want to mess with it too much so I simply asked the Landlord to replace the filter and he supposedly did!! I am angry as all heck and want to sue this ******* for his lies and intentional deception and utter disregard for my health, he even knows that I work out of the home so I am always here breathing in who knows what! Please help asap! This is a disgrace! Thank you.

6 years? what do u think u can sue for? what did u do to mitigate your damages?

if my car driving down the street aggravates your allergies, are u going to sue me? how about the dealer who dold me the car? what about the guy who sold me the gas that caused the car to burn toxic fumes? yeah...there ya go...sue Hess Oil Co for all they're worth to make up for your sniffles!!

but seriously, you have some responsibility in this too. after 6 years of illness, you did nothing to alleviate your problems. you should have checked it out sooner. you could have moved (you aren't a prisoner are you?)

but that's the american way...always someone else's fault.

did the building inspector say the heating system was up to code? check and see if he was required to pull a permit and if it was every inspected(since it is a rental unit) or how about this, check with the health department about the mold in the basement. you are drawing the mold spores from the basement thruout the house. that could cause serious respitory problems.
