| My 16-year-old son (full time high school student, properly licensed) was driving his father’s car (unit 2) in the city of Dallas, TX and was at a complete stop at an intersection waiting for the traffic signal to change, when unit 2 was rear-ended by another vehicle (unit 1). Accident occurred late in the evening under clear weather and road conditions. Dallas police report includes witness stating he was stopped alongside unit 1 at the previous intersection approximately .6 mile away. Unit 1 was revving up his engine and took off at a high rate of speed. Witness said he was traveling 60 MPH and at that speed unit 1 still passed him. Unit 1 slammed into back of unit 2. Witness observed accident.
Is this considered gross negligence? If so, can I file a gross negligence claim against other driver’s insurance company without using an attorney? If so, how? What compensation claim is considered fair and reasonable for this sort of accident? |
