help! Should I sue?

My car was totaled because my neighbor is at fault. Since my car was a lease I have no say so. Their Insurance company and my bank settled for amount. Now I am left with paying what is left. The insurance company will only pay for a rental for 1 week. After that I must pay or get a car the only problem I am still waiting for my discharge papers from my bankruptcy. Then everywhere I go I am looking at a down payment for a car. I do not have the money. CAN I SUE MY NEIGHBOR FOR WHAT I AM OUT? Like the rental car and a down payment?
